Limitation of liability, Indemnity

IN NO EVENT SHALL KLICK INC., LAKERIDGE HEALTH, OR THEIR RESPECTIVE DIRECTORS, TRUSTEES, PROFESIONAL STAFF APPOINTEES, EMPLOYEES AND AGENTS BE LIABLE TO USER OR ANY THIRD PARTY FOR ANY DAMAGES ARISING OUT OF THE USE OF THE TOOL INCLUDING WITHOUT LIMITATION CONSEQUENTIAL, INCIDENTAL, INDIRECT DAMAGES.

As a condition of using this Tool, User releases Klick Inc., Lakeridge Health, and their respective directors, trustees, professional staff appointees, employees and agents from any liability in connection with the use of the Tool and User agrees to defend and indemnify Klick Inc. and Lakeridge Health, and their respective, directors, trustees, professoinal staff appointees, employees and agents from any and all claims and damages in any way arising from the use of the Tool.
